Medical records are just the first part of proving 9/11 compensation claims.

You also need proof of presence. Lawyers handling medical malpractice, personal injury or bad drug plaintiffs are usually only trying to prove the physical injury took place and typically only need medical records to make their case.

But with the 9/11 World Trade Center victims in New York City who are seeking compensation for any one of 68 types of cancer or the many illnesses and conditions covered under the September 11th Victims Compensation Fund, medical records are just the beginning.

Injured parties also have the burden of proof of presence in the World Trade Center Ground Zero exposure zone. They must prove they were in the wrong place at the wrong time:

  • Worked in rescue, recovery and/or cleanup operations after the attack
  • Lived in Lower Manhattan, below Canal Street (that includes the neighborhoods of Chinatown and Tribeca)
  • Worked a regular job in Lower Manhattan, below Canal Street
  • Attended school or university in the exposure zone
  • Lived or worked along the route by which WTC debris was transported to the landfills or barges/loading piers
  • Worked at the Fresh Kills landfill or the NYC morgue.

If you lived there, you can prove it with identification such as a driver’s license or voter registration card, utility bills, an insurance policy or a property tax bill or lease.

If you worked there, you can use pay stubs, employer ID or records, income tax forms, WTC site credentials any official human resources or personnel documents.

If you went to school there, enrollment records or transcripts should be easily attainable.

There are other documents that could help you prove a regular presence at the WTC exposure zone, including store receipts, Metrocard transit records, photographs and emails. It is always good to collect as many of these as you can.
