9/11 Victims Compensation – Everything to Know About the Zadroga Act

Thе James Zаdrоgа Hеаlth аnd Cоmреnѕаtiоn Act of 2010 also known as the 9/11 Victim Compensation Act is a U.S. law, passed in 2010, to provide health monitoring and financial aid to the first responders, volunteers and survivors of the Sept. 11, 2001 attacks by Al-Qaeda-backed terrorists.

Named after James Zadroga, a New York Police Department officer whose 2006 death was attributed to exposure to the toxic chemicals at Ground Zero at the World Trade Center,  the law funds and establishes a health program to provide medical treatment for anyone who experienced or may still experience health complications related to the attacks and the rescue and clean up efforts in New York City, Washington D.C. and Pennsylvania.

The signing of the Zadroga Act also reactivated the September 11th Victim Compensation Fund, which was authorized to operate through 2016 until President Barack Obama signed into law a bill that extended the reauthorization of the VCF, allowing individuals to submit claims through Dec. 18, 2020.

The Eligibility, Compensation, Personal Injury and Deceased claim forms have been combined into one new, simplified form. And the Private Physician packet is now part of the claim form to make it easier to submit with your claim. A new, one-page “claim form signature page” replaces the former multiple page attestations and certifications.

The VCF site has a “navigation tip sheet” and a new “document checklist” to help survivors and their relatives gather the supporting documents they need for their claim.

The word “victim” on the form refers to the individual who was diagnosed with 9/11-related cancer, injury or condition. The word “claimant” refers to the person filing the claim to seek compensation for the victim. Anyone filing on their own behalf is both.

Both portions of any claim, the eligibility and the compensation sections, must be submitted before the VCF reviews and begins to process any claim.

While a hard copy claim forms are still available, the VCF encourages victims and claimants to submit their claims online. You can use this system to:

  • Create an account and register, which preserves your right to file a future claim
  • Complete and submit the claim form.
  • File an amendment to a previously submitted claim
  • Upload supporting documents to a claim.
  • View correspondence sent by the VCF.
  • Update your contact information or your attorney’s information.
  • Review any information you provided on your claim, including any information you may have entered on a form that you started but have not yet submitted.

The one thing that stands most in the way between a 9/11 survivor and their compensation is proof of presence. Victims must prove they were in the vicinity of lower Manhattan during or for months after the attacks. Establishing presence along with the medical condition is key to having the injury or sickness linked to the 9/11 attacks.
